These general conditions of sale apply strictly to all sales of products made in mainland Spain by COMERCIOS LOPEZ NIETO, SL with C.I.F. number B-30806376, a commercial company that operates through the Internet from its website (www.elportillodecoracion.es) hereinafter EL PORTILLO DECORATION.
Any order made to THE PORTILLO DECORATION necessarily implies as an essential condition, decisive and essential, the unreserved acceptance by the Customer of the Terms and Conditions of Sale of EL PORTILLO DECORATION in force on the day on which the corresponding order is placed. To guarantee in its completeness the rights of consumers and users of COMERCIOS LOPEZ NIETO, SL, these General Conditions are established in accordance with the provisions of Spanish law, and in particular in Law 7/98 of April 13 of The Conditions General Procurement, Law 7/96 of 15 January on Retail Trade Management, Civil Code, Directive 2000/31 EC of the European Parliament and of the Council of 8 June, Law 34/2002 of 11 July on information society services and electronic commerce , Royal Legislative Decree 1/2007, of November 16, approving the Consolidated Text of the General Law for the Defense of Consumers and Users and other applicable laws and their development regulations.

Any User of the website shall be deemed to be a Customer www.elportillodecoracion.es who places an order and gives his/her acceptance at the time of its placing.
The Customer must register as such and provide the following details in order to place the order: first and last name or company name, CIF/NIF, invoice address, delivery address, contact telephone number and contact email.
This data will be processed in accordance with the provisions of the Conditions of Access and Use of the website and in the section“Legal Notice”.
The prices published in EL PORTILLO DECORATION are in Euros and are valid, except typographical error. All prices carry the VAT included applicable on the day of the order, any change of VAT rate will be automatically applied to the prices of the products for sale in EL PORTILLO DECORATION.

3.- Acceptance of the order

Payment will be made in cash at the same time as the store is picked up in puerto de Mazarrón (Murcia), during business hours.
Payment can be made in cash or card, no checks or bank stubs will be accepted.
Payment by bank card or PAYPAL account of the customer.
Payment by bank card of the customer through the banking platform associated with the POS of the online store.
The system will automatically calculate the shipping cats associated with the type of product selected by the customer, and its amount will depend on the total amount of the sale (being free for sales greater than 100 euros except in case of furniture), and the dimensions and weight of the product purchased.
The customer will receive shipping charge information automatically during the purchase process.
The offers submitted by EL PORTILLO DECORATION are valid within the time limit and the available stock. THE PORTILLO DECORATION reserves the right to modify the assortment of products according to the conditions imposed by its suppliers.
The photographs, graphics and descriptions of the products offered for sale are only indicative and do not involve the seller in any way.
Each product has a fact sheet that includes the technical characteristics, an indicative photograph (if applicable), the retail price of the product with VAT included. Shipping costs are not included in this price.
Due to the artisanal nature of some handmade products, there may be variations from one unit to another, regarding the termination, color, textures, dimensions, etc., The customer is aware of this aspect at the time of purchase, and accepts these conditions.
The total cost of the order will be communicated to the Customer at the time of placing his order and in advance of acceptance of the same.
6.- Portes and delivery times
Regular delivery time for all orders in which the material is in stock 24h-48h. In case of furniture the period can be extended from 3 to 5 days depending on the transport company.
In no case can we guarantee these delivery times although we will try to ensure that the transport companies comply with them whenever possible. In rural towns far from urban centres it is not possible to guarantee delivery in 24 hours.
Shipping costs will be indicated in your shopping cart prior to payment of the order.
7.- Delivery of orders
Delivery times depend on product availability (24/48 hours) or furniture (3/5 days).
In orders placed in the payment method by transfer, the reliable record of the payment by the Customer by bank transfer will also be taken into account for the calculation of delivery times.
However, this period of availability may be modified in the event of simultaneous orders on the same product or products involving the end of the product’s stock. If the end of stock is final, the Customer will be notified to choose a different product of similar characteristics and a price similar to the product exhausted, or cancel your order, with the amount paid in advance refunded in the case of orders with prepayment method.
Delays in deliveries longer than ten days depending on the period of availability, delay attributable to EL PORTILLO DECORATION, will entitle the Customer to the cancellation of his order if he so declares it in writing by e-mail to the address email@example.com, returning, where appropriate, the money paid in advance, and without any claim for damages, present or future, direct or indirect.

The delivery will be made at the delivery address indicated in the shipping data of the order. Subsequent modification of this address may result in a number of expenses that will be borne by the Customer.
Orders will be delivered by transport company to the delivery address indicated by the Customer and to the person who has set himself as the recipient thereof. This data will be entered on the delivery note of the shipping company, which will also indicate the number of shipment packages, the total weight and the order number.
In addition to the packing slip, a purchase invoice will be delivered to the Customer with each order, either inside the shipping packaging, or a purchase invoice.
If at the time of delivery it is visible and clear, without the need to handle the shipping packaging or the product’s own, that a product has defects caused by transport damage or is appreciated, in the same way, an error in the goods received, the Customer must enter it on the delivery note and communicate it to EL PORTILLO DECORACIÓN S.L (by email address to the address firstname.lastname@example.org) within 24 hours of receipt of the order in order to urge the return of the affected product or products and thus the replacement with a new one or the refund of the price paid by it.
If the invoice is missing, the Customer may request it by email to the address email@example.com, indicating the name of the invoice holder and the order number, and will be sent to the invoice address by regular mail.
8.- Use of the product and customer responsibility

The company is not responsible for misuse, improper use or any other incident caused by the handling or installation of the product.
9.- Return and cancellation policies
Return of goods
Our policy, complying with the current regulations contained in Article 44 of Law 7/1996, of January 15, on The Management of Retail Trade, is to grant you the right to return any item purchased in EL PORTILLO DECORATION within 14 days of the date of receipt. The Customer may be required to desist from the order to bear the direct cost of returning the product.
You will not have to provide any explanation, any item, purchased in EL PORTILLO DECORATION, returned in its original packaging, sealed and in perfect condition will be accepted.
No withdrawals from orders will be accepted.
Within 30 days of receipt of the return, EL PORTILLO DECORATION undertakes to refund you.
Before making the return, you will need to inform the Customer Service department.
If the cause of the return is that the returned item is defective or does not correspond to what was requested in the order, EL PORTILLO DECORATION will bear the costs of the return and new shipment. If the reason for the return is that the order does not satisfy you, we will refund the amount but not the shipping costs or the return costs.

A period of 2 years from the time of delivery is recognized so that the buyer can enforce his rights. The warranty covers any manufacturing defect but is not applicable when the fault is caused by improper handling thereof.
The procedure for these cases shall be as follows:
Communication to our management department the damage or breakdown. THE PORTILLO DECORATION will send, to the email address specified by the customer the document designed for this purpose that must be correctly completed and attached to the defective material in the shipment to our facilities.
Once here, the product is reviewed by the technical department of the brand, if it is under warranty it will be repaired or replaced.
The customer must take care of the costs of sending this material to our facilities, EL PORTILLO DECORATION will be responsible for the costs of shipping the repaired or replaced material to our customer.
